The judge who opened the investigation into police brutality along Melilla border fence has decided to prosecute the commander in chief of the Civil Guard in Melilla for the crime of breach of trust. The commander ordered officers to return migrants as soon as they enter into Spain through the Melilla border, i.e., without respecting the process established by the Aliens Act. According to the judge, such an order is illegal and can constitute a crime. The judge also clarifies that, contrary to the government's version, the Melilla fence is part of Spanish territory.
