The judgement, based on the case law of the European Court of Human Rights, opens the door for incapacitated people across Europe to request their addition to voters' registers, allowing them to take part in elections.

The District Court of Nowy Sacz ordered that an incapacitated person be entered in the voters' register, reversing the earlier decision of the city’s mayor. The court found that the blanket deprivation of incapacitated persons' right to vote in elections to the European Parliament violates the European Convention on Human Rights, the Convention on the Rights of Persons with Disabilities and European Union law.

The decision's wider implications are to allow partially incapacitated European citizens across the EU to be registered as voters and gives fully incapacitated people legal grounds to become registered.
