Commissioner for Human Rights of the Council of Europe Nils Muižnieks has presented a third party intervention for the joined cases of N.T. and N.D. v Spain, which regard the summary returns of two Malian citizens from the border of Melilla. The commissioner concluded that the summary returns, although legally protected in Spain with the recent legislative reform, prevented the two from effectively exercising their right to seek asylum and their right to access to an effective remedy, therefore violating the European Convention on Human Rights.
