Underage refugees are granted special and legally recoverable rights under the Dublin Regulation, states a decision of the highest German Administrative Court. The EU's Dublin Regulation lays down which member state is responsible for any asylum procedure. There is a special regulation for minors, which - according to the court - also serves to protect their fundamental rights. Minor asylum seekers can therefore claim an individual right out of the regulation. In the specific court case, Germany tried to expel a refugee to Belgium even though Germany was responsible.
