The European Court of Justice has ruled on Spain's new legislation on mortgage evictions, which had been previously modified due to another decision of the CJEU that it violated the Directive on Unfair Terms. The Court has now established that the new law, which allows banks to appeal the decision denying evictions but prevents individuals from appealing when a judge decides not to deny it, violates both the aforementioned directive and the right to a fair trial. Since the start of the crisis, over 300,000 families have lost their homes in Spain.
