Last week, the European Court of Justice issued an important judgment in a case launched by the Spanish NGO Malaga Acoge. The court ruled that the Spanish Aliens Act violates EU law because it permits the automatic refusal of a residence permit, or an expulsion solely based on a criminal record for people from outside the European Union who have exclusive custody of minors who are EU citizens. According to the court, the right to family life must prevail.
