A prerequisite for the state secretary of security and justice to be able to put an alien - who has no right of residence in the Netherlands - in temporary custody is the prospect of deportation within a reasonable period of time. However, since the beginning of October of this year, there is no prospect of deportation of a group of Somali aliens within reasonable time. This appears from a November 5 judgment of the Administrative Jurisdiction Division of the Dutch Council of State, in an appeal case by a Somali alien against the judgment of the District Court of The Hague.
