The Dutch Council of State has decided that State Secretary Klaas Dijkhoff may impose conditions to the sheltering of people without a residence permit. It may be expected that they cooperate in their own departure in exchange for 'bed, bath and bread.' A lower court had earlier ruled differently, referring to the European Social Charter, the ECHR and a decision of the European Committee of Social Rights. However, the Council of State states that the ruling of the ECSR is not binding for the countries that signed the convention.
